Please Read These Terms
These Terms of Service ("Terms") govern your access to and use of Super Editor, related Super OS desktop workflow utilities, our websites, accounts, collaboration features, and associated services provided by 13 Layers LLC (collectively, the "Services"). By downloading, installing, registering for, signing in to, or using the Services, you agree to be bound by these Terms. If you use the Services on behalf of a company, production studio, agency, or other legal entity, you represent and warrant that you possess full legal authority to bind that entity, and "you" refers to both you individually and that organization. If you do not agree to these Terms, do not install, access, or use the Services.
These Terms do not supersede any separate signed written agreement between you and 13 Layers LLC. Connected third-party providers, APIs, or software components remain subject to their respective terms. If a separate written agreement with 13 Layers LLC expressly conflicts with these Terms, that separate agreement controls.
1. Definitions

2. Eligibility, Younger Creators, and Accounts
We encourage younger creators, students, and emerging artists to explore, learn, and master modern visual storytelling and creative AI workflows. However, to ensure a safe, responsible, and legally compliant environment, the following age requirements apply:
- Minimum Age: You must be at least 13 years of age to use the Services. Super Editor is not directed to children under 13, and we do not knowingly permit access to or collect personal information from individuals under 13.
- Users Between Ages 13 and 17 (Younger Creators): If you are between 13 and 17 years old (or the legal age of majority in your jurisdiction):
- Parental or Guardian Agreement: You may use Super Editor only with the consent and supervision of your parent or legal guardian. By allowing you to access the Services, your parent or legal guardian agrees to be bound by these Terms and assumes full legal and financial responsibility for your compliance with them.
- Educational and Institutional Use: If you use Super Editor through an accredited school, academic program, or creative workshop, your educational institution or instructor represents and warrants that it has secured all necessary parental/guardian consents required by applicable law to permit your access.
- Understanding Prompting and Proper Tool Use: Younger creators agree to learn and practice responsible prompt craft, ethical AI usage, and respect for digital media integrity. You agree not to generate harmful, harassing, or deceptive media, nor attempt to bypass safety or moderation guidelines set by 13 Layers LLC or third-party Connected Providers.
- Account Security and Credentials: Provide accurate registration information and keep it updated. You are solely responsible for safeguarding your login credentials, local machine security, and any API keys you enter into the application. You accept full responsibility for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized access or credential compromise.
3. The Services and Local-First Architecture
Super Editor is designed as a desktop-first, local-first creative production workspace. Timelines, project databases, cache files, media references, and local node graphs are executed and stored on your local hardware.
- Beta and Preview Features: Certain releases, modules, or features may be designated as alpha, beta, preview, or experimental. These features are provided strictly for evaluation, may contain bugs or incomplete features, and may be modified, limited, or retired at any time without notice.
- Your Backup Obligation: You bear sole responsibility for maintaining independent, verified backups of all project files, original source media, project databases, and final exports. 13 Layers LLC is not responsible for data loss, project file corruption, rendering errors, or system crashes.
- Verification: Generative tools, node automation, transcription, color transforms, and analysis engines can make mistakes or yield unexpected results. You must verify and quality-check (QC) all edits, cuts, visual transforms, and exports before commercial delivery, broadcast, or public release.
4. Application Architecture, Zero-Retention, and Third-Party Pass-Through
Super Editor is locally installed client application software. It functions solely as a creative workspace, node orchestrator, and technical conduit.
- Independent Pass-Through Conduit: To the extent Super Editor enables connections, integrations, webhooks, or bridges to third-party services, platforms, cloud storage, or external APIs (including generative AI models, render farms, or transcription engines), all such connections operate on a strict pass-through basis. Super Editor does not broker, meter, or resell in-app generation tokens or compute credits.
- Sole Responsibility of Third-Party Providers: Any third-party service or Connected Provider you configure or access through Super Editor is provided entirely by that independent third party, NOT by 13 Layers LLC. The availability, quality, performance, uptime, security, pricing, data privacy, terms of service, acceptable use policies, license grants, and outputs of those services are the sole and exclusive responsibility of the respective third-party service provider.
- Direct Contractual Relationship: Your use of any Connected Provider constitutes a direct legal and commercial relationship between you and that third-party provider. You are solely responsible for:
- Complying with that provider’s terms of service, API agreements, and usage limits;
- Reviewing that provider’s data retention, safety filtering, and model training policies; and
- Paying all compute fees, subscriptions, or API usage costs incurred directly with that provider under your own billing relationship (Bring Your Own Key / BYOK).
- Complete Disclaimer of Pass-Through Liability: 13 Layers LLC exercises no control over, and expressly disclaims any and all legal, operational, financial, or contractual liability arising from:
- Any act, omission, policy change, price increase, or service outage of a Connected Provider;
- The rejection, moderation, filtering, or loss of any prompt, payload, or media sent to a third-party API;
- Content generated by, or intellectual property disputes arising out of, a third-party model or platform; or
- Data breaches, credential leaks, or unauthorized retention occurring on a third-party provider’s servers or infrastructure.
- Zero Retention of Creative Assets: 13 Layers LLC does not store, host, inspect, or retain your raw footage, audio stems, project timelines, node graphs, or exported media on our servers. Your project files and media remain exclusively on your local hardware (or your selected personal storage) under your sole proprietary control.
- Strict Ban on Proprietary AI Training: Under no circumstances does 13 Layers LLC use, scrape, ingest, or process Your Content, project timelines, node configurations, prompts, or Output to train, fine-tune, evaluate, or improve any proprietary machine learning, deep learning, or artificial intelligence models.
5. Sole Proprietary Ownership of Creative Content, Output, and Open Licensing
- Your Sole Proprietary Ownership: As between you and 13 Layers LLC, you (or your clients/licensors) own and retain all right, title, interest, and intellectual property in and to Your Content, projects, timelines, node workflows, compositions, and all media created or processed within Super Editor. 13 Layers LLC acquires zero ownership, copyright, or equity interest in any of your work. All work remains under your sole proprietary control. Nothing in these Terms restricts or diminishes your right to use, license, or distribute Your Content or Output under Creative Commons licenses, open-source licenses, or public domain dedications, provided you comply with the terms of those respective licenses.
- Ultra-Narrow Operational License: You grant 13 Layers LLC only the strictly limited, technical permissions necessary to run the software on your hardware and execute commands you affirmatively initiate (such as local rendering, audio/video playback, and active peer-to-peer screen/review transmission when using Super Team Features). This operational permission confers no ownership, distribution, or commercial exploitation rights to 13 Layers LLC and terminates immediately when the technical operation concludes.
- Proprietary Control of Output: All Output generated, rendered, or exported via Super Editor is under your exclusive direction and proprietary control. 13 Layers LLC makes no claim to your Output. Because third-party model generation rules and statutory copyrightability standards vary by jurisdiction, you remain solely responsible for ensuring your commercial use of Output satisfies third-party clearing, union/guild requirements (e.g., WGA, SAG-AFTRA), and applicable intellectual property laws.
6. Super Team Collaboration and Sharing
When you initiate screen sharing, peer review, project synchronization, or invite collaborators via Super Team Features, you authorize the transmission of session metadata, audio/video feeds, timeline data, and media previews to those designated recipients.
You are responsible for managing access permissions and revoking links when a collaborator's authorization ends. 13 Layers LLC cannot recall or erase materials once transmitted to or cached on another collaborator's local workstation.
7. Acceptable Use
You agree to use the Services only for lawful creative and business purposes. You must not use the Services to:
- Infringe, misappropriate, or violate any copyright, trademark, trade secret, privacy, publicity, or moral rights;
- Create, distribute, or facilitate child sexual abuse material (CSAM) or content depicting the non-consensual exploitation of minors;
- Generate deceptive, defamatory, or fraudulent synthetic media ("deepfakes") intended to mislead the public, defame individuals, commit fraud, or simulate someone's voice/likeness without legal authorization;
- Use generative prompting, voice cloning, or facial synthesis tools to target, harass, bully, or create non-consensual synthetic media depicting classmates, teachers, minors, or any other individual;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of Super Editor (except to the extent such restriction is prohibited by applicable law or permitted by governing open-source licenses);
- Circumvent license keys, bypass activation controls, probe security vulnerabilities, or deploy malicious code;
- Resell, rent, or lease the desktop application, or offer it as an unauthorized shared service bureau;
- Access non-public APIs or proprietary UI components to build or train a directly competing commercial application.
8. Fees, Subscriptions, and Merchant of Record
Access to Super Editor, license keys, or advanced software tiers may require payment of fees.
- Payment Processing & Merchant of Record: Payments for software licenses and subscriptions are processed through authorized payment infrastructure, including Stripe and/or Lemon Squeezy. Where Lemon Squeezy acts as the Merchant of Record (MoR), the purchase transaction is legally concluded between you and Lemon Squeezy, which handles sales tax, VAT remittance, and invoicing in accordance with Lemon Squeezy's Terms of Sale. Where Stripe is utilized, 13 Layers LLC is the merchant, and payment processing is handled in accordance with Stripe’s service terms.
- Billing & Renewals: Paid subscriptions automatically renew for successive billing periods at the then-current standard rate until cancelled. You authorize the applicable payment platform to charge your selected payment method.
- Cancellations & Refunds: You may cancel recurring software subscriptions at any time via your customer billing portal. Cancellations apply to the subsequent billing cycle. Unless otherwise required by local law or specified at checkout, license fees are non-refundable once software activation keys are delivered.
9. Intellectual Property & Trademarks
13 Layers LLC and its licensors retain all right, title, and interest in and to the Services, underlying code, visual interfaces, documentation, and assets.

12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL 13 LAYERS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF CLIENT PRODUCTION CONTRACTS, DATA LOSS, SYSTEM CRASHES, OR HARDWARE FAILURE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF 13 LAYERS LLC FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF:
(A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO 13 LAYERS LLC (OR ITS DESIGNATED MERCHANT OF RECORD) FOR ACCESS TO SUPER EDITOR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR
(B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).
NOTHING IN THESE TERMS PURPORTS TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT BE LAWFULLY EXCLUDED UNDER APPLICABLE CALIFORNIA LAW.
13. Indemnification
You agree to defend, indemnify, and hold harmless 13 Layers LLC, its affiliates, managers, members, employees, and agents from and against any third-party claims, liabilities, damages, losses, and reasonable legal expenses (including attorneys' fees) arising out of or related to:
- Your Content or Output produced under your direction;

- Your violation of any third-party intellectual property, privacy, or publicity rights; or
- Your use or configuration of any Connected Provider API key or service.
14. Dispute Resolution: Informal Resolution, Binding Arbitration, and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND HAVE A JURY HEAR YOUR CLAIMS.
- Informal Negotiation: Before filing a formal claim, both you and 13 Layers LLC agree to participate in an informal dispute resolution process for at least thirty (30) days. Send written notice to [email protected] describing the issue, factual basis, and specific relief sought.
- Mandatory Binding Individual Arbitration: If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be settled by final, binding individual arbitration administered by JAMS under its Comprehensive or Streamlined Arbitration Rules, before a single neutral arbitrator. The seat and place of arbitration shall be San Francisco, California, or conducted remotely via secure videoconference by mutual consent. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
- Class Action and Representative Relief Waiver: YOU AND 13 LAYERS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
- 30-Day Right to Opt Out: You have the right to opt out of this arbitration agreement and class action waiver. To opt out, you must send written notice with your full name, account email, and an unequivocal statement opting out of arbitration to [email protected] within thirty (30) calendar days of first downloading, installing, or accessing Super Editor. These Terms, and any dispute arising out of or related to them, are governed by and construed in accordance with the laws of the State of California, United States, without giving effect to conflict-of-law principles. For disputes not subject to arbitration under Section 14, you and 13 Layers LLC submit to the personal and exclusive jurisdiction of the state and federal courts located in Alameda County or San Francisco County, California.
